Recreation Area Project Started

Our recreation area project started next to the pool, this month, October 2023! (This is right at the entrance off of Margate Blvd where the shuffleboard courts used to be.)

Members recently got to vote where they wanted the association’s credit card rewards fund to be applied. The biggest area voted on, was re-doing the old shuffleboard court recreation area into a nice place to sit with a gazebo and two benches.

Perfexion Construction came and filled in the two trenches with concrete to create a level surface for our new patio. Once this is completed, the patio will be power-washed and painted.

We hope you enjoy seeing our small steps to beautify our common area! Members here at Garden Patio Villas will be able to see the end of this project completed in 2024.

No Garbage Dumping

This notification is a reminder that garbage dumping is not allowed at Garden Patio Villas!

Please place garage bins out on Wednesday or Saturday. Bulk garage is only on Saturday. You should place the bulk items outside (in front of your own home) the night before since bulk items get picked up very early.

One time someone dumped a pile of garage on Poinsetta Way. Melodie, the President worked with Rafael in cleaning it up!! Thank you, Ralph Brandenburg!! We do not want our community in Garden Patio Villas looking this way again!

I Marshall Hyman

We sadly announce that I Marshall Hyman (Marshall) died surrounded by family after a long illness with kidney disease on Sunday, July 9, 2023. He is survived by his wife Brenda, and their adult children Noel and Chari. Marshall and Brenda were married for 62 years and were childhood sweethearts! They met as teenagers in Ocean Township, New Jersey. He served his country as a Marine, became an industrial engineer and loved traveling and collecting art from all over the world. He was an avid researcher and scholar.

Marshall was a beloved and well respected Member of our community, Garden Patio Villas, for 28 years. He served on the HOA Board as Treasurer for 14 years and was instrumental in keeping the community thriving. He loved helping others. He lived with Brenda at 7708 Margate Blvd. C9U3.

His family is thankful for the many years they got to enjoy him and will continue to cherish his memories.

Qualifications to Be on the Board of Directors

Do you have an interest in being on Garden Patio Villa’s Board of Directors? There are qualifications to be on the Board that are found in our Governing Documents along with the Florida State Statutes. Being on the Board, takes 5-10 hours a week. Are you interested in helping make decisions for our Association?

What are the qualifications to be on the Board?

  1. Must be a Member of Garden Patio Villas and listed on the deed of a dwelling unit.
  2. No delinquent dues or assessments to the Association.
  3. No convicted felonies.
  4. Complete a Board Certification Course within 90 days of getting on the Board. (good for four years)
  5. Complete four hours of Continued Education Classes every year.
  6. Sign Code of Conduct agreeing to adhere to Association and State rules.

What are some ideal skills in being a good Board Member?

  1. Honesty
  2. Transparency
  3. Consistency
  4. Team Player
  5. Willing to Serve
  6. Communication skills
  7. Organization skills
  8. Computer skills
  9. Management skills
  10. Available to accomplish tasks

Powers and Duties of Our Board of Directors

Powers of Board Members

Garden Patio Villa’s Governing Documents set the general powers and duties of the Board of Directors and the specific limitations upon the Board’s powers.

Garden Patio Villa’s Board has the power to:

  1. Adopt and publish “Rules and Regulations” to protect the interests of the Homeowners’ Membership by governing the use of the common area and facilities.
  2. Establish penalties for violation of our Governing Documents.
  3. Hire or fire independent contractors or managers as deemed necessary to upkeep the Association property. This includes:
    • Contract and pay for maintenance, gardening, materials, and supplies relating to the Common Area.
    • Employ additional personnel reasonably necessary for the operation of Garden Patio Villas.
  4. Pay the utilities rendered on our Common Area.
  5. Set the amount of assessments and maintenance fees of each villa Member and collect these monies.
  6. Create a budget and use funds as described in our Governing Documents.
  7. Purchase and maintain adequate liability insurance on Garden Patio Villas’ property.
  8. May suspend the voting rights during any period in which a Member shall be 90 days default in payment of any assessment levied by Garden Patio Villas.

Duties of Board Members

Any Member who wants to be on the Board of Directors of Garden Patio Villas must read our Governing Documents and Rules and Regulations. A Member must sign and agree to adhere and comply with ALL of our HOA rules. A Member can not have any financial unpaid debt to the Association.

Within 90 days after becoming a part of the Board of Directors, Board Members must:1

President

  1. The President is the Chief Executive Officer; ultimately responsible to see that orders and resolutions of the Board of Directors are carried out.
  2. The President of the Board presides over all meetings of the Board of Directors.
  3. The President signs and reviews all Association contracts.
  4. The President oversees all finances.
  5. The President oversees and interacts with the Lawyer on all legal issues.
  6. The President sends email to Members and communicates any updates.
  7. The President oversees our website for updates and articles.
  8. The President oversees all aspects of the Association so it runs as required by Rules and Regulations, Florida Statutes, and our Governing Documents.

Vice President

  1. The Vice President acts in the place of the President in the event of his/her absence or need for assistance.  
  2. The Vice President helps the President and Lawyer out with any legal issues.
  3. The Vice President handles getting insurance for the Association.
  4. The Vice President organizes and processes the application process and required forms for the purchasing of villa properties within our Association.
  5. The Vice President processes the background screening package for new Buyers.
  6. The Vice President notifies our Webmaster of new villas for sale.
  7. The Vice President answers the phone for the Association.

Secretary

  1. The Secretary writes all letters written on behalf of our Association.
  2. The Secretary signs all letters written from the Association.
  3. The Secretary creates Meeting Minutes and sends to Webmaster
  4. The Secretary supplies hard copies at the mailbox area for Members without email.
  5. The Secretary is keeper of the corporate seal of our Association and affixes it on all papers requiring the seal.
  6. The Secretary gives, legally required, notice of all meetings on the Community Bulletin Board within 48 hours.
  7. The Secretary helps write articles for our website.

Treasurer

  1. The Treasurer receives and deposits maintenance fees of all Members and other incoming monies to the Association’s bank account.
  2. The Treasurer maintains the financial record of the Association and disburses such funds as directed by resolution of the Board of Directors.
  3. The Treasurer signs all checks for our Association.
  4. The Treasurer completes Estoppel Certificate requests.
  5. The Treasurer prepares monthly expense reports.
  6. The Treasurer prepares an annual statement of income and expenditures to be presented to all Members at the annual elections meeting.
  7. The Treasurer takes care of submitting annual state or government fees and paperwork.

Member at Large

  1. The Member at Large fulfills duties as assigned by the President or by the Board to help full-fill all duties needed.
  2. The Member at Large helps upload forms in Google Documents and hard copies, as needed.
  3. The Member at Large helps write articles for our website.
  4. The Member at Large helps contact Members when needed.
  5. The Member at Large helps purchase needed supplies for the Association or the Board Members.
  6. The Member at Large cleans the clubhouse and mailbox area, as needed.
  7. The Member at Large works with renting the Clubhouse and confirms the clubhouse is clean without any damage issues.
  1. Florida HB 1021 was passed into law and becomes effective July 1, 2024. ↩︎

Many times you hear people state how awful Homeowner’s Associations (HOAs) tend to be. Is living in a HOA worth it? A HOA can be viewed many times by people as a strict community. Why? Because people are comparing it to living in a single family home which does give you a lot more freedom to do as you want. Living in a HOA means you have restrictions that you would not have if living in a single family home. What’s the difference? There are Governing Documents which guide each HOA. There are also state laws which must be followed for condos and Homeowners Associations.

Members should continue to use the green bin for trash (collected twice each week) and the blue bin for recycling (collected once per week).
