PURPOSE: Discussion and Results of Proposed Amendments to the Declaration of Restrictions and Bylaws

Proposal 1 – FAILED for two-thirds of Member votes and did not pass.

Proposal 2 thru 21 – PASSED for two-thirds of Members votes and passed.

NOTE Per our 2004 Governing Documents:
Bylaws require a ⅔ vote from the total number of Member votes received which was 77. This equates to 52 votes to pass.
Declarations require a ⅔ vote from the total number of Member villas which is 83. This equates to 56 votes to pass.

OLD BUSINESS:
Melodie called the Board meeting to order. Barbara opened the meeting with the reading of minutes from last month. Accomplishments were stated:

Invoice for the new pump has been paid ($5,479.02)
Sprinkler check has almost been completed. Sprinklers had to be shut down due to the build up of algae in the canal.
The City of Margate will resume cleaning the canal and has been working on getting the canal free of the algae. We will put the sprinklers back on once they have completed their process. Thankfully, it has been raining a lot.
Water leak in Cluster 5 has been found and repaired. Owners need to be mindful if they have problems with their bathroom toilets they need to be repaired immediately. These issues cost the association, which is all of us, extremely high water bills.
The coconuts have been removed from all the trees that were a concern
The situation regarding the trees that have been a major concern was brought up for discussion. Upon recommendations from our Arborist, the trees that will be removed will be the one on the golf course behind 3-7 and 3-8 and the diseased one behind 5-3 and the rest of the cluster of trees in that area will be trimmed as well as the one behind 4-4. All other trees will have to wait till next year. The Board voted and approved the work to be performed on September 24th.

NEW BUSINESS:

Proposed Amendments have been completed, packages have been handed out to most of our Owners. Owners that are not home, or were out, their packages have been emailed or sent by US Mail. The Lawyer is requesting Restricted Proxy Votes due to COVID 19. Proxies are due back September 18th. We will hold a Member Meeting on Tuesday, September 22nd at 7 pm at the clubhouse and on Zoom. Seats in the clubhouse are limited due to COVID restrictions.

The Board voted and approved raising the Maintenance compensation to $220. per month. This job requires a lot of time and work keeping up with the general appearance and issues of our community. This position oversees all of our vendors ie; lawn service, sprinklers, trees, pool, repair estimates, light poles and signage issues. Any maintenance issues should be addressed to Joe. (C3U3) He is in charge of Maintenance and can be reached at (754) 444-6654 or by email at gpvmaintenance@gmail.com.

Barbara brought up the possibility of doing some community events toward the end of October if Broward County COVID restrictions permit. More discussion on this subject will continue at the next Board meeting.

Our HOA Water and Running Toilets

As you know, our Homeowners Association pays for everyone’s water. This is included in your maintenance fees! What happens to our HOA finances when there is a running toilet?

When an Owner has a running toilet, it raises our water bill! This is not free water! If the running toilet is ignored over a couple months, it means our Association is losing hundreds of dollars! This money that is a combination of all Owners’ monies is being wasted!

Our Association is on a limited budget. No one wants to raise the maintenance fees yet when our water bill sky rockets due to a running toilet or a leaky faucet what are we to do?

Let’s look at the last few months increase of water bills due to running toilets at the clubhouse and at an Owners home:

July – Excess cost from one running toilet – $125
August – Excess cost from the same running toilet – $300
In addition, excess cost from two running toilets in Clubhouse – $480
September – Not yet determined. (The problems were found and repaired.)

Unfortunately, these increased water bills means we spent money we could have used to help cover expenses such as: trim our trees, cut down diseased trees, replace missing hedges, or redo our private roads.

Let’s work together to watch for running toilets in our own villas and in the community clubhouse. If no one fixes the problem, our water bill raises and we lose a lot of money. Let’s stop this from re-occurring and save our Association money now and in the future!

Sanitizer and Masks for Margate Seniors

Garden Patio Villas and other Senior Communities in Margate, Florida were blessed to get care packages this week! Today, August 21, 2020, Vice Mayor Arlene Schwartz and Commissioner Anthony Caggiano dropped by with a helpful crew to deliver these items to us!

The donated care packages consist of sanitizer and a Margate mask! The City of Margate held this special program this week and all senior communities were invited to join in Margate. Two care packages will be given to each villa Owner here at Garden Patio Villas Association.

The Board of Directors will be passing them out the week of August 23rd at our information meetings being held this coming week. For those who are unable to attend or who are attending the zoom information meeting, we will be dropping them off at your villa.

Thank you to our City of Margate for the donations and making this happen! Thank you to all the wonderful workers who helped to deliver the sanitizers and masks to our senior communities! We appreciate you and the care masks and sanitizer we received!

President, Melodie opened the meeting.

The 21 proposed amendments were reviewed and voted approved by all Board of Directors.

Informational Meetings for Owners on the 21 proposed amendments will be scheduled as follows:

Tuesday, August 25 – 7-8 PM on Zoom
Wednesday, August 26 – 7-8 PM Clubhouse (limited to 10 owners)
Thursday, August 27 – 3-4 PM Clubhouse (limited to 10 owners)
Saturday, August 29 – 10:00 AM Clubhouse (limited to 10 owners)

The Official Membership Meeting for Member voting of proposed Amendments will be held on September 22, 2020 at 7 PM on Zoom

OWNERS PRESENT: C3U3, Maintenance, C3U5, C3U10

The meeting was called to order. Melodie addressed everyone on how the meeting should run regarding any questions Owners may have.

OLD BUSINESS:

Melodie asked Joe on Maintenance for an update on items that have been accomplished this last month that he oversees. Joe states the following:

SPRINKLER PUMP The sprinkler pump finally has been installed and is working. It was necessary for the irrigation company to do another clean out due to the build up of algae that accumulated when the canal reached level. They also added a special 3” adapter to the end of the hose to help prevent future clogs. There will be an extra charge of $200. for that service which will need to be included in their payment.

SPRINKLER CHECK The sprinkler check was done by our lawn company. There were many broken sprinkler heads that were replaced and others repaired. There may be a few that still need repair which will be taken care of when they are back on the property. There will be extra charges for the ones that needed to be replaced. Owners may contact us with problems pertaining to the direction of any problem sprinklers.

TREES PROBLEMS & COCONUTS Our tree service was here this week and cut the coconuts down from 4 trees that Owners were concerned about with hurricane season upon us. While they were on the property, the Owner and a Certified Arborist checked all the trees that are a concern. Presently, we have 5 trees that need attention. One in particular, in the front of C3U11, that tree is the worst because it is split and very vulnerable to cause damage. They will be sending an estimate with his findings and cost to take care of each tree. Everything cannot be done at once due to finances, however we have agreed to do as much as possible. The others will be taken care of next year.

SECURITY Margate Police signs have been installed at entrances on Lemon Tree, Margate Blvd and at the pool area. One more will be installed at the entrance on Strawberry Lane.

DRIVEWAYS Joe will be coordinating painting of driveways with a company. Melodie will get the bottom line discounted price for the approved color through Sherwin Williams. Owners that want their driveways painted need to contact Joe or send a request to the Association’s email. Owners will get a rebate of $50.00 from the Association after the driveway is painted.

WATER – Water was found running in one toilet in the men’s bathroom at the Clubhouse. Owners need to be mindful when flushing the toilet that it stops running. The water bill was higher due to this issue.

The meeting then proceeded with the reading of the Minutes from last month by Secretary, Barbara. All items have been completed with the exception of the Amendments to the By-laws. Melodie stated that we are in the final stages, our lawyer has compiled all of the changes and additions according to current HOA laws and has presented them back to us for review and approval. We will be meeting next week for a final review before proceeding forward sharing the proposed amendments with all of our Owners..

NEW BUSINESS:

Marshall, our Treasurer informed the Board of the following:

INSURANCE The Association’s quarterly payments are due again and will have to be paid at the end of this month.

HOA FEES Two of our Owners with outstanding HOA fees have paid the Association. On that subject, we discussed that according to Section II of the Rules and Regulations the HOA fees are due on the 1st day of each quarter. A 10 day grace period is given and after that period a late fee of $25.00 will be imposed. A letter will be sent to any Owner that is late as a reminder, if ignored, a second letter will be sent and if still not paid, a lien will be placed at time of sale. Owners need to include late fees with their payment. If there is a specific financial problem, please notify a member of the Board in advance or call/email/text the Association to discuss the financial situation..

WATER BILL Cluster 5 was $150.00 over normal usage and Cluster 4 was approximately $60.00 more and the Clubhouse was higher, probably due to running the toilet. Melodie will send an email out as a reminder for Owners to keep an eye out for running toilets and leaky faucets.

PREVIOUS LAWN CARE SERVICE Marshall did a thorough investigation into our previous lawn service. He found that they billed us twice for some services and charged us for services never done. They billed us for services at the time we fired them. After reviewing all of our previous billing and confirmed service never completed we find that they owe us money. The Board agreed and voted that we send all this information and their contract to our attorney for her review and recommendations on how to resolve this matter. The previous lawn representative also has stated he will take it to court.

The meeting was then turned over to Melodie, our President. She brought forward the following items for discussion:

RELEASE FORM Create a release form for contact numbers and emails of Owners that want to be part of a Owner Directory. According to the law, permission is needed to have your information in the Directory. Barbara was asked to create the form that will be included in the mailing of the proxy letters that will be going out for voting on the new proposed Amendments.

COMMON ELEMENTS APPROVAL FORM Barbara was asked to create a form for common elements. Any Owner that wants to make any changes or additions to common areas need approval of the Board of Directors. There is a list identifying the Common Elements in Section V of the Rules and Regulations, which is available to all Owners on our website.

AMENDMENTS TO BY-LAWS We discussed the options available to vote on the proposed amendments. Due to COVID-19, we have not been able to have quarterly Association Board Meetings. We have tried very hard to keep all Owners abreast of what is going on through emails and posting the minutes and important information on the Association bulletin board as well as GPV website. Some of the suggestions were: Zoom Meeting and separate meetings outside with no more than 15-20 residents with masks and practicing social distancing. Melodie will send out a survey to see what your thoughts are. When concluded and a decision is made we will notify everyone.

BEE PROBLEM We have a bee problem they are in the hedges around the sprinkler pump. A Margate company has been here 3 times. It has been suggested to remove hedges to avoid future infestation; that would leave just the wall which may not be palatable to look at, Joe suggested painting the wall and planting flowers around it. However, the Board decided due to the funds, to have hedges cut down to 4′. If bees come back we will remove the hedges next year when funds are available.

HURRICANE TREE TRIMS VS.HOA FEE INCREASE After receipt of those who responded to the survey, the Board learned of financial situations that some of our Owners are facing. The Board has agreed and voted against raising the HOA fee $20.00. The Board will continue to trim trees for hurricanes every other year instead of on a yearly basis.

Melodie then asked attending Owners if they had any questions. No one stated they did.

Margate Flag Committee Visits Garden Patio Villas

This past weekend, Margate Flag Committee (a group of Margate residents) stopped by our Garden Patio Villas Homeowners Association and paid us a visit!

Margate Flag Committee was created in 2019 as a community organization that volunteers time and finances to help persons who physically need help to put a flag up on their home.

Although somewhat halted during COVID, members of this group came out this past weekend for a visit! A few special volunteers came and put up the American flags for our community.

Garden Patio Villas was blessed to have Margate Mayor Tommy Ruzzano, his wife Amanda and Rob Reiner who volunteered their time and finances to give and hang up flags to three Owners in our villas!
