
The recent vote on the proposed amendments for Garden Patio Villas resulted in several of the proposed changes failing to pass. Because these specific items were not approved, they will not be added to our official Governing Documents.
Here is an overview of what this outcome means for our community’s day-to-day operations, finances, and regulations.
Because the proposed amendments regarding repairs and damage did not pass, the responsibility for maintaining and repairing these items remains unchanged. The Association will continue to pay for these expenses on common area and Members will continue to be responsible for maintenance and repairs on their own property. Because the HOA remains financially responsible for these ongoing costs, HOA monthly fees cannot be lowered. ARC Forms and Planting forms on your property are still required per our Governing Documents.
Garden Patio Villas remains an official 55+ active adult community and must continue to follow all rules set by Housing and Urban Development (HUD). Although the specific definition will not be added to our Governing Documents, our 55+ status and HUD compliance remain fully in effect.
Overnight street parking remains strictly prohibited. Because the proposed amendment to define exact overnight hours did not pass, it will be up to the Board of Directors to determine what “overnight” means. Residents and guests should be careful when parking on the street late at night, as unapproved vehicles may be towed at the Member’s expense.
